Ozannes’ Litigation, in conjunction with other departments of the firm, can offer an effective one-stop service for offshore legal services. Any litigation of substance in the Channel Islands is likely to have Ozannes’ Litigation on one side or the other and the Jersey practice, which opened in March 2007 is growing in reputation and strength.
Ozannes’ Litigation has Advocates, Barristers and Solicitors with substantial experience before the Guernsey, Jersey and English Courts, and can draw on the experience of members of a team who, between them, have practical experience at the English Bar, academic experience in the fields of trusts and tax and practical experience within the litigation departments of UK law firms. Most of the Ozannes’ Litigation lawyers are fully qualified English lawyers. In addition, each Advocate has studied French and Guernsey or Jersey law to obtain the extra qualifications required to practise before the Royal Court of Guernsey or Jersey.
The 2006 Lawyer Awards praised Ozannes’ Litigation for its involvement in the Flightlease Group liquidation in which Ozannes advised the joint liquidators. Ozannes’ Litigation is currently involved in some interesting and key cases such as Soulbury Ltd v Royal Bank of Scotland, involving a frozen bank account and the use of the US Patriot Act, and an unfair dismissal claim, in which Ozannes is representing the employer in the first case under The Employment Protection (Guernsey) (Amendment) Ordinance, 2006, which has enacted provisions concerning sex discrimination.
In addition to this Ozannes has advised on substantial multi-jurisdictional freezing orders; three-way disputes between funds, investment managers and custodians; breach of confidentiality, international succession disputes; insolvency and all manner of heavy commercial, common law and civil litigation. It also has particular experience in human rights’ law.
Ozannes has lawyers with a wealth of experience in dealing with family and matrimonial disputes. In particular, Adrian Brown, who joined the team in 2001 from his practice in England, has specialised in all aspects of matrimonial law, including high value ancillary relief cases. He is also a trained mediator and a member of the Family Mediators Association and the first trained collaborative lawyer in the Channel Islands.
Ozannes’ Litigation Partner, Gordon Dawes, has prepared a commentary on recent noteworthy cases in Guernsey. To view the latest brief visit the publications section of Ozannes’ website. To receive future updates and to be added to the mailing list, e-mail your request to: advocates@ozannes.com
